1. Acceptance of these terms

These Terms & Conditions (“Terms”) govern your use of the recruiting and staffing services provided by ITSutra Inc. (“ITSutra,” “we,” “us,” or “our”) and the Screenings platform at screenings.itsutra.com. By using our services, communicating with us, or opting in to receive messages from us, you agree to these Terms. If you do not agree, please do not use the services.

2. Our services

ITSutra represents candidates in their job search and placement. As part of this, we may collect candidate information, conduct AI voice screenings through the Screenings platform, submit candidates to open roles, and communicate with candidates by phone, email, and text message about their job search.

3. SMS / text messaging terms

By opting in, you agree to receive recurring automated and non-automated text (SMS) messages from ITSutra related to your job search. This section is the messaging program disclosure for our SMS program.

Program description and message types

Messages include job submission updates, interview scheduling, document requests, screening invitations and reminders, and recruiter replies.

How you opt in

Consent is collected only after you have engaged ITSutra to represent you in your job placement, so an existing business relationship exists at the time of opt-in. You provide prior express consent in one of two ways:

• Candidate-initiated: you text ITSutra directly after receiving our number from your recruiter, establishing opt-in by your own initiation; or
• Verbal consent on a recorded call: during a recorded phone call, your recruiter asks whether you agree to receive SMS updates about your job search, and you verbally confirm.

ITSutra does not purchase, rent, share, or upload phone numbers from any third party, and consent is never bought from a list provider.

Additional messaging terms

• Consent is not a condition of service. Consent to receive text messages is not a condition of being represented by ITSutra.
• Carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier’s network availability.
• You are responsible for notifying us if your mobile number changes and for keeping your contact information current.
• For how we handle your mobile number and opt-in data, see our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

4. Acceptable use

You agree to provide accurate information, to use the services only for lawful job-seeking purposes, and not to interfere with, disrupt, or attempt to gain unauthorized access to the platform or its data.

5. Intellectual property

The Screenings platform, its software, content, and branding are owned by ITSutra Inc. or its licensors and are protected by applicable laws. These Terms do not grant you any right to our trademarks or proprietary materials.

6. Disclaimers

The services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not guarantee employment, placement, or any particular outcome from using our services.

7. Limitation of liability

To the maximum extent permitted by law, ITSutra Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for message and data charges imposed by your carrier, arising out of or relating to your use of the services or the messaging program.

8. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the services after an update constitutes acceptance of the revised Terms.

9. Governing law

These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law principles.
